What is a partition lawsuit?
A partition lawsuit is a special type of lawsuit filed by a person with an interest in property to either divide that property to satisfy their interest or to sell the entire property so that they can receive the monetary compensation for the percentage of their interest in the property.
Most times people think of a partition action in terms of real estate and dividing interest in real property or selling the real property to satisfy an interest but actually a partition action can occur in any type of property including personal property.
